Kazakhstan Client Instructs Foreign Lawyer Jianing Shen to Handle Foreign Trade Contract Dispute
Our foreign lawyer Jianing Shen was entrusted by a client from Kazakhstan to provide comprehensive foreign legal services including the prevention and control of legal risks, formulation, prosecution and execution of litigation strategies in a foreign trade contract supply dispute with a company in Guangzhou.
The client indicated that, due to multiple factors involving cross-border trade activities and subsequent business dealings, the contract dispute with a company in Guangzhou which had been delayed over and over failed to be properly resolved. And it did take a great deal of effort to find Lawyer Shen.
Lawyer Jianing Shen pointed out that, foreign-related contract disputes are usually complicated to handle given the combined effects of multiple locations involving domestic and foreign trade, as well as its own characteristics.
As a lawyer, it is necessary to take the interests of the client into full consideration, in conjunction with the characteristics of the foreign trade industry and the litigation strategy of foreign-related contract disputes, in order to make risk warnings and develop a complete service strategy for the client to make decisions.
In this case, the most challenging points were firstly, the necessity to tailor a cost-effective solution for the client; secondly, the need to do due diligence on the creditworthiness of a company in Guangzhou; and thirdly, the imperative to fully maintain the long-term relationship between the client and the other party,in order to minimize the impact of the dispute disposal process on the partnership.
Lawyer. Shen proposed to do due diligence on the Guangzhou company first and then make initial contact by sending a lawyer's letter; at the same time, she also had to plan for the long term and prepare for the execution of the subsequent cases for the parties. Considering that both the obligation to pay for the goods to refund after the termination of the contract are borne by the Guangzhou company, it is essential to certify the commissioning procedures and the litigation documents for the proceedings in advance in the country by the embassy or consulate.
